
RWWA Stewards today concluded an inquiry into a report received from Western Diagnostic
Pathology in regards to the presence of banned substances in the urine sample submitted by
Jockey Clint Harvey at the Lark Hill Trials on Monday, 12 December 2011.
Evidence was taken from Jockey C. Harvey, Principal Investigator Mr Phil O’Reilly and Western
Diagnostic Pathology Analyst, Mr Tyren Edwards.
Jockey Harvey pleaded guilty to charge under ARR.81A (1) (a) for providing a urine sample
that was found to contain the banned substances Oxazepam, Nordiazepam and Temazepam
(Benzodiazepines).
Jockey Harvey had his licence to ride suspended for a period of two months, however acting
under the provisions of ARR.81D, Stewards ordered that six (6) weeks of this penalty is to be
stayed in whole for a period of twelve (12) months on the condition that he does not re-offend
the drug rules within that period and that he immediately commences a counselling program as
directed by the Stewards. Such penalty is to take effect from the expiry of his current
suspension at midnight on 26 December 2011 and will expire at midnight on 9 January 2012 at
which time he will be permitted to resume riding in races. As Jockey Harvey has since provided
a urine sample free of any banned substances, Stewards have subsequently removed the
stand down order imposed from Monday, 19 December 2011 and he is therefore able to
resume riding in track work and trials immediately.
In assessing penalty, Stewards took into account the following factors:
- Guilty plea and level of remorse
- No prior offences under the drug rules
- Seriousness of the offence
- Honest and forthright manner
- His personal circumstances
