RWWA Stewards today resumed the adjourned inquiry into a report received from the ChemCentre in Perth, that the post race blood sample taken from TAIAHA NZ after it competed and finished unplaced in Race 1, the See The Cup Movies Pathway Series MS Pace (1700m) at Gloucester Park on Friday, 7 October 2011, had a level of total carbon dioxide (TCO2) in excess of 36.0 millimoles per litre in plasma.
This finding has been verified by Racing Analytical Services Ltd in Victoria ('RASL').
At today's hearing, Mr Reed advised that he had obtained new legal representation and leave was granted for Mr L. Margaretic to appear as counsel. Mr Charles Russo (ChemCentre) and Dr. Judith Medd (RWWA Veterinarian) were also in attendance and gave further evidence at the inquiry.
Counsel for Mr Reed at the outset of proceedings, made application for the matter to be adjourned in order for additional evidence, that being the screening data for the 14-days preceding the analysis of TAIAHA NZ's sample, to be obtained from the laboratories, The application was supported by submissions via telephone from Dr. P. Casey who had been called by counsel for Mr Reed.
After considering the application the Stewards determined that they were not persuaded that the requested data is relevant to the certification process that applied at either laboratory and would therefore not be directing the laboratories to provide such data. The matter would therefore proceed on the materials provided to this point by both laboratories.
The matter was subsequently adjourned at the request of Mr Reed's counsel in order to prepare submissions in light of the Stewards decision today. A date for resumption will be determined upon confirmation by counsel that he has obtained the file from Mr Reed's previous counsel and is in a position to present submissions.
Acting under the provisions of Harness Rule of Racing 183 (d), the Stewards directed that all licences held by Mr Mark Reed be suspended forthwith pending the outcome of the inquiry. Mr Reed is therefore essentially stood down from training or driving race horses with immediate effect.
