
RWWA Stewards today conducted an inquiry into a report received by RWWA Principal Investigator Phil O’Reilly relating to incidents involving Licensed Track Rider Ms Myra Ives and Licensed Trainers Mr Jason Burdon, Mrs T. Itzstein and Mr R. Ives at the Pinjarra Race Club on Saturday 21 July 2012 and Tuesday 24 July 2012.
Evidence was taken from the above persons and Trainers Mr C. Itzstein and Mr A. Beacham, Licensed Track Rider Ms C. Marlin and the General Manager of the Pinjarra Race Club Mr Michael Lodding.
Ms Ives was charged with three separate offences of improper conduct under ARR.175(q).
On the first charge, Ms Ives pleaded guilty to a charge of improper conduct in that on the morning of Saturday, 21 July 2012 she used offensive language towards Trainer Mr J. Burdon in the area of the practice barriers.
For the second charge, Ms Ives also pleaded guilty to a charge of improper conduct for forcefully pushing Mr Burdon in the stall area on the above morning.
In relation to the third charge, Ms Ives was found guilty to a charge of improper conduct for intentionally riding her mount into Mr Burdon causing him to be pushed backwards on the above morning.
For the first offence, Ms Ives was fined the sum of $500.
For the second offence, Ms Ives had her track rider’s licence suspended in full for a period of three (3) months. This penalty was ordered to be served concurrently with the nine (9) months suspension issued for the third offence.
For the third offence, Ms Ives had her track rider’s licence suspended in full for a period of nine (9) months with three (3) months of this penalty to be stayed under the provisions of ARR.196(4) for a period of twelve (12) months on the condition that Ms Ives does not incur any further misconduct offences during this period of time. In assessing this penalty Stewards took into account the seriousness of the matter in that her actions were potentially dangerous and reflected poorly on the image of racing and her prior good record over many years.
Mr Jason Burdon pleaded guilty to a charge of improper conduct under ARR.175(q) in that on the morning of Saturday, 21 July 2012 he used offensive language towards Ms M. Ives in the area of the practice barriers. Mr Burdon was fined the sum of $500.
Mr R. Ives was reprimanded under ARR.175(q) for improper conduct for speaking to Ms T. Itzstein in an inappropriate manner during trackwork at Pinjarra Race Club on Tuesday, 24 July 2012.
