On Monday 7 August 2017, a hearing was conducted before the Racing Penalties Appeal Tribunal (RPAT) in relation to an application for a Stay of proceedings following the lodgment of an appeal by Mr Greg Bond on Thursday 3 August 2017 regarding the Stewards decision to impose a disqualification for breaches of Rule 209 & 243 (6 and 12 months respectively to be served concurrently – refer RWWA Media Release 2 August 2017 for details).
The Acting Chairman of RPAT resolved to refuse the stay application.
Following the denial of the stay application, counsel for Mr and Mrs Bond requested a hearing before the Stewards with respect to the direction to suspend Mrs Bond’s training licences pending determination of the application of the relevant rules of harness racing as they relate to Training partnerships, in particular Harness Regulation 90.1 (8) (c) which states:
(8) RWWA may grant a trainers licence to a person to train only in partnership.
(c) Each partner shall be subject to any disability, fine, suspension, disqualification or other penalty that may be imposed under the rules on any partner.
A hearing was conducted at 3.00pm yesterday in relation to the above.
After hearing submissions the matter was adjourned in order for:
- Mr and Mrs Bonds legal counsel to provide further written submissions with respect to the application put before Stewards to allow Mrs Bond to continue training from the registered training establishment of the Partnership in view of the rules and conditions.
- The Stewards to conduct an inspection of the registered training establishment to ensure a full appreciation of the venue and the proposed arrangements that would apply if Mrs Bond was to train from there.
before the Stewards determine the matter insofar as it relates to the training licence of Mrs Bond.
In view of the Stay refusal and pending determination relating to Mrs Bond’s training licence, the restrictions of disqualification continue to apply and no nominations for any horses located at the registered training establishment of the partnership will be accepted.
Mr Bond has been permitted to maintain horses at his property pending the outcome of this matter before Stewards, however all other restrictions of disqualification apply to him.
