Thoroughbred – Stewards’ Inquiry – OUR BRUCIE BONUS (Trainer Mr Ray Malpass) – Nor-West Jockey Club (Roebourne) 29 July 2017.
RWWA Stewards today concluded an inquiry into a report received from the ChemCentre in Perth, that the prohibited substances phenylbutazone and its metabolite oxyphenbutazone were detected in the blood sample taken from OUR BRUCIE BONUS after winning Race 6, the Supagas Handicap over 1400m at the Nor-West Jockey Club (Roebourne) on Saturday, 29 July 2017.
This finding had been verified by the Australian Racing Forensic Laboratory in NSW.
Evidence was taken from the Trainer of OUR BRUCIE BONUS, Mr Ray Malpass, ChemCentre Analyst Ms Kelly Wilson and RWWA Industry Veterinarian Dr Judith Medd.
Trainer Mr Ray Malpass subsequently pleaded guilty to a charge under AR.178 for bringing OUR BRUCIE BONUS to the Nor-West Jockey Club (Roebourne) to compete in the above race with the prohibited substances phenylbutazone and its metabolite oxyphenbutazone being detected in the post-race blood sample taken from the gelding.
Mr Malpass was subsequently fined the sum of $5000.
In considering penalty Stewards took into account the following factors;
- The seriousness of the charge in relation to AR.178.
- The prohibited substances being classed as anti-inflammatory / therapeutic and the levels detected.
- His guilty plea, co-operation throughout the inquiry and personal circumstances.
- His prior record over a long period which showed no prior offences under the prohibited substance rules.
Acting under the provisions of AR.177, OUR BRUCIE BONUS was disqualified as the winner of the above race with the placings amended accordingly.
