Harness Stewards Inquiry – Trainer Mary Kulscar (WE TELLTHETRUTH)

Racing and Wagering Western Australia (RWWA) Stewards have finalised an inquiry into the shockwave treatment of WE TELLTHETRUTH NZ prior to it competing in Race 3 at Gloucester Park on Tuesday 14th April 2020.
At the inquiry evidence was heard from:
Mary Kulscar – Trainer of WE TELLTHETRUTH NZ
Geoff Johnson – RWWA Senior Investigator
Mrs Kulscar pleaded guilty to the following charges under Harness Rules of Racing and was issued with the penalties as indicated.
Charge 1 – Rule 239A – The particulars of the charge being that Mrs M. Kulscar, did cause WETELLTHETRUTH to undergo shockwave therapy on Tuesday 7 April before it proceeded to race at Gloucester Park on Tuesday 14 April which was conduct that led to a breach of HR213B.
Penalty – $2,000 fine
Charge 2 – Rule 213B – The particulars being that Mrs Kulscar did fail to record shockwave therapy administered to WE TELLTHETRUTH in her log book as required.
Penalty – $300 fine.
In determining penalty Stewards took into account the following factor:
Mrs Kulscar’s co-operation and acknowledgement of all offences by way of her guilty pleas.
Her offence record which showed no prior offences under these rules.
That in relation to WE TELLTHETRUTH, the Stewards were satisfied that the shockwave therapy that took place was six days prior and as such the treatment would have had little effect on the gelding.
That WE TELLTHETRUTH finished 12 in the event.
Previous penalties for offences under these rules.
Further acting under Harness Rule of Racing 195, WE TELLTHETRUTH was disqualified from the race in question with placings to be amended accordingly.
