RWWA Integrity Assurance Committee (IAC) – Issue of ‘Show cause’ notice to Mr Darryl Wayne Stone
The Integrity Assurance Committee was established by the Board of RWWA under section 47 of the Racing and Wagering Western Australia Act 2003 (Act). Amongst the functions conferred on the IAC by RWWA under section 49(2)(b) of the Act are RWWA’s function relating to Warning Off under section 44(1)(e) of the Act, and as prescribed by Section 72 of the RWWA Regulations 2003 (Regulations).
Following a report from the RWWA General Manager Racing Integrity recommending that the IAC issue Mr D W Stone a “warning off notice”, the IAC issued Mr Stone a ‘show cause’ notice, inviting him to request a hearing as to why RWWA should not exercise those powers in relation to ‘warning off’ against him.
A hearing before the IAC was conducted on 20 January 2020, at which Mr Stone appeared.
After taking all matters into account, the IAC on 24 February 2020 determined to exercise its powers under Section 44(1)(e) of the Act to issue Mr Stone with a ‘warning off notice’ in accordance with Regulation 72(1) of the RWWA Regulations. In making this decision, the IAC took into account all the relevant submissions presented by Mr Ron Davies QC on behalf of the Stewards and Mr Stone.
Accordingly Mr Darryl Wayne Stone is a person who has been ‘warned off’ and incurs, in accordance with the RWWA Rules of Thoroughbred Racing, the same restrictions as a disqualified person.
