Stewards Inquiry – Mr Graham Berry

RWWA Stewards have now completed their inquiries with respect to disqualified person Mr Graham Berry entering upon 20 Windfire Grove Nambeelup on 31 December 2015.
A Prosecution Notice from the Magistrates Court of Western Australia indicating that Mr Berry pleaded guilty to trespass upon 20 Windfire Grove Nambeelup on 31 December 2015 was obtained which coincided with surveillance vision showing Mr Berry entering upon this kennel property, on this day.
On the 12 March 2016, Mr Berry was afforded the opportunity to make written submissions with regard to his alleged attendance and the potential application of Rule 99 and 100. No submissions were received. The relevant rule provides;
R99 Effect of disqualification, suspension, warning off or being declared a defaulter
(3) Unless the Controlling Body in special circumstances otherwise directs, a person who has been disqualified, warned off or declared as a defaulter is not-
(g) to enter or go or remain on, at any time, any place where greyhounds are trained, kept or raced.
The location of 20 Windfire Grove NAMBEELUP was at all material times a place where greyhounds are trained and kept. Mr Berry as a disqualified person is prohibited from entering such locations.
Accordingly the Stewards determined that the evidence confirmed that Mr Berry had breached the restrictions of this rule.
In accordance with Rule 100, a person shall automatically have their period of penalty recommenced as from the most recent date of breach. The provisions of this Rule are absolute upon a breach of Rule 99 being confirmed.
R100 Penalty to be recommenced
The period of penalty imposed on a person who is disqualified or warned off shall automatically be deemed to have recommenced as from the most recent date of the person breaching Rule 99.
Accordingly, the original penalty of 10 years disqualification will now be recommenced as of 31 December 2015. The disqualification term will now officially expire on 30 December 2025.
