Thoroughbred Stewards’ Inquiry – Jockey Ben Kennedy
Racing and Wagering Western Australia stewards have determined the matter of penalty following the stewards’ inquiry conducted on 10 February 2022 where, after hearing evidence, jockey Ben Kennedy pleaded guilty to a charge under AR139 (1)(b).
The particulars of the charge: When providing a sample of urine at the direction of RWWA stewards at the offices of RWWA on 1 February 2022, he substituted such sample by way of a device that was found to be strapped to his body at the time.
After considering all relevant matters, the stewards determined the appropriate penalty to be a disqualification of 18-months, effective as of 1 February 2022, which is the date when Mr Kennedy was effectively suspended pending the outcome of this matter.
Stewards took into account, among other things:
- His personal circumstances, overall record in racing and guilty plea.
- Past penalties issued with respect to attempted substitutions which were commonly no less than 12-months’ disqualification.
- That as a result of the substitution, stewards had been denied the important ability to screen a sample from a rider who had ridden track work on the day.
- That matters of occupational health and safety arise for both the offender and others which are significant given the inherent dangers of riding.
- The need for the penalty to serve as deterrent and send a clear message that such actions will result in serious consequences.
