Show Cause Notice Issued To The Albany Harness Racing Club

The Integrity Assurance Committee (IAC) has today issued a ‘Show Cause’ notice to the Albany Harness Racing Club under Section 40 of the RWWA Act and Rule 2 of the Rule of Harness Racing.
Following a report received from the RWWA General Manager Integrity, Denis Borovica, the IAC will consider cancelling the registration of the Albany Harness Racing Club (AHRC) and thus its ability to conduct race meetings in accordance with the provisions listed below. A number of concerns have been brought to the IAC’s attention in relation to the operations, management and conduct of the AHRC resulting in a ‘show cause’ notice being issued.
The IAC is established by the Board of RWWA under section 47 of the Racing and Wagering Western Australia Act 2003 (Act). Under section 35(1) of the Act, RWWA’s functions includes its functions to control, regulate and supervise racing in the State and to supervise racing clubs and their affairs.
Section 40 of the Act provides:
40. Registration of racing clubs
- RWWA may, in accordance with the rules of racing and the regulations, register or refuse to register a racing club.
- An applications for registration is to be made in a form approved by RWWA
- Registration may be issued subject to such conditions as RWWA determines.
- RWWA may, in accordance with the rules of racing and the regulations, suspend or cancel the registration of a racing club.
Rule 2 of the Rules of Harness Racing provides:
2. Registration Procedure
- A club desiring to promote or conduct meetings or races may make application to the Controlling Body for registration.
- An applications shall be made in the manner and form and be accompanied by such documentation, information and fees as the Controlling Body may determine.
- The Controlling Body may grant registration upon such terms and conditions as it thinks fit.
- Registration may be refused by the Controlling Body without assigning any reason.
- Registration may be cancelled by the Controlling Body for breach of a rule or term or condition of registration.
The AHRC is entitled to be heard by the IAC prior to any decision and exercise of power to cancel the Club’s registration. The IAC has issued the AHRC a ‘show cause’ notice, inviting the AHRC to request a hearing within 14 days of receiving the notice.
IAC Chair, Dr Lianne Cretney-Barnes, invites interested parties to provide written submissions as to whether the IAC should cancel the registration of the AHRC.
